Comprehensive evidentiary dossier proving breach of contract, serial delays, bad faith, and fraudulent claims by SBW Engineering
This portal serves as the definitive, forensic, and unchallengeable record of the commercial fabrication and erection contract for the 165-foot diameter circular PEB dome structure at Al-Barakah Marquee, Sheikhupura between Al-Barakah Marquee (Principal / Owner) and Syed Mazhar Abbas (SBW Engineering - Labour & Fabrication Contractor).
Syed Mazhar's False Claims & Fabricated Excuses
Claims Al-Barakah unlawfully seized his Honda City and Cheque "by force".
Falsely claims he met 100% of construction and erection timelines.
Attempts to rely solely on preliminary handwritten meeting notes from 28 July 2026, concealing the formal contract delivered 1-2 hours later.
Using criminal police pressure to evade a net financial deficit and contractual liability.
Forensic & Irrefutable Ground Reality
Over PKR 2,710,128.00 disbursed to Syed Mazhar (17 verified bank transfers + site labour settlements).
The Honda City and Cheque were voluntarily surrendered as contractual performance security under Clause 7 (Cheque Security).
Formal Urdu/English contract (FD-SBW-2026-001) was drafted & delivered via WhatsApp within 1–2 hours of the 28 July meeting.
SBW repeatedly breached milestones, abandoned site crews, and failed structural erection (central compression ring misalignment).
Primary Legal Grounds for Defense & Police Complaint Dismissal
Pure Commercial Contractual Dispute: The subject matter is a commercial engineering and fabrication contract governed by civil contract law. The Supreme Court of Pakistan has repeatedly ruled that police authorities cannot interfere in commercial transactions or act as recovery agents for civil disputes.
Voluntary Performance Collateral: The vehicle documents and security cheque were handed over voluntarily pursuant to explicit contractual clauses governing milestone advances. Alleging "extortion" or "theft" is patently malicious and contradicted by WhatsApp time-stamps.
Section 182 PPC Liability: By submitting a false criminal report to a public servant (SHO), Syed Mazhar has rendered himself liable for criminal prosecution under Section 182 PPC.
Complete Exoneration of Fusion Developers: Saleem Sb and Mian Usman acted strictly as technical consultants and pro-bono dispute resolution coordinators. They have zero financial share, zero contractual liability, and hold no custody of vehicle or funds.
Status of Parties: Third-Party Neutrality & Indemnity for Fusion Developers
Strict Legal Distinction & Immunity for Saleem Sb and Mian Usman
Third-Party Coordinator
Saleem Sb & Mian Usman
Fusion Developers / Technical Consultants

Legal Declaration for Investigating Officers & Advocates:
"Saleem Sb and Mian Usman (Fusion Developers) act strictly as technical advisors and dispute resolution facilitators. At no point did Fusion receive, hold, or benefit from the Honda City vehicle or the security cheques, which were exclusively deposited with Al-Barakah Marquee under contractual terms. Any attempt by Syed Mazhar to drag Fusion into criminal proceedings is a frivolous tactic to harass neutral professionals."
Master Chronological Timeline of Events & Evidence
From 3 Months of Chronic Failure & Site Abandonment to the 28 July Lahore Mediation, Sohail's Distress Logs, Structural Damage, and the Final 20 August Signed Stamp Paper
Definitive Case Chronology
This forensic timeline traces the day-by-day progression of the project, establishing through time-stamped WhatsApp logs, audio recordings, video proofs, bank transfer receipts, and registered legal instruments why Syed Mazhar (SBW) is solely liable for structural damage, financial deficits, and criminal misrepresentation under Section 182 PPC.

April – Mid July 2026
3 Months of Serial Failure, Unearned Advances & SBW Running Away
Phase 1: Chronic Default
Al-Barakah Marquee disbursed over PKR 2,135,000.00 across multiple direct bank transfers to Syed Mazhar for early fabrication and mobilization of the 165-ft circular dome PEB shed. Despite receiving immense liquidity:
SBW suffered from chronic workforce shortages, untrained welders, and severe workshop fabrication delays.
Multiple completion commitments were broken continuously over 90 days.
SBW Absconded: When Al-Barakah demanded physical progress and accountability, Syed Mazhar abandoned the site, took his personal tools, and cut off communication, leaving the marquee project in total jeopardy.
Verified Proof: 17 Direct Bank Transfer Slips (Meezan Ref #01–#29)

28 July 2026 • Afternoon
The Lahore Mediation Meeting & 1-Hour Contract Delivery
Phase 2: Formal Contract Binding
CRITICAL FACTUAL & LEGAL DISTINCTION:
Third-party coordinators (Fusion Developers: Saleem Sb & Mian Usman) intervened to prevent complete project collapse and called Syed Mazhar to Lahore for a 3–4 hour marathon mediation session. Mr. Sohail (Al-Barakah) was NOT present in Lahore.
Because Mr. Sohail was absent, preliminary handwritten points were jotted down as non-binding negotiation notes. To formalize and legally bind both parties:
Contract Delivered in 1 Hour:
At 11:43 PM (within 1 hour post-meeting), Mian Usman drafted the comprehensive 6-page Contract (FD-SBW-2026-001), translated all legal terms into Urdu, and delivered it via WhatsApp to Mazhar and Sohail.
Clause 7 Cheque Security:
Explicitly mandated that for daily mobilization advances released, SBW would provide post-dated security cheques and collateral returnable only upon verified milestone completion.
01 August Erection Milestone Missed • Erection Delayed by 10 Days
Phase 3: Immediate Breach
Under the restart agreement, SBW committed that the entire circular dome structure would be hoisted and standing by 1st August 2026. Al-Barakah immediately released daily mobilization cash (Rs. 50,000 on July 28, Rs. 50,000 on July 29, and Rs. 50,000 on Aug 1).
The Reality on Ground: On 1st August, not a single main truss was erected. SBW arrived with inadequate rigging equipment, failed to provide crane guidelines, and once again missed the critical opening milestone.
Official Letters & Escalation Notices Served to SBW (28 July – 10 August 2026)
7 Registered Legal Notices & Written Directives Served Prior to the 10 August Delayed Erection Start
Documentary Paper Trail
To establish total accountability and eliminate informal verbal ambiguity, the project coordinators served 7 formal written letters and escalation notices directly to Syed Mazhar via registered WhatsApp and email between 28 July and 10 August 2026. These letters prove continuous warnings regarding timeline breaches and idle crane demurrage:
Compliance Directive29-Jul-2026
SBW Engineering Compliance Directive
Formal written directive served to SBW following the 28 July agreement, ordering immediate welding resumption, red-oxide primer supply, and delivery of workshop cleats.
Undeniable Legal Proof:These 7 time-stamped notices shatter SBW's fraudulent claim that "timelines were met without objection."

10 – 19 August 2026 (10 Days Late Start & Fabrication Flaws)
10-Day Delayed Erection Start • 1-2 Day Job Turns into 9-Day Disaster Due to Fabrication Defects
Phase 4: Catastrophic Site Crisis
Engineering Standard vs. SBW Fabrication Failure:
Under professional PEB engineering standards, hoisting and erecting pre-fabricated circular trusses is typically a 1 to 2 day job. SBW did not even begin erection until 10 August (10 days past the 1st August milestone). Furthermore, because of severe workshop fabrication errors (misaligned bolt holes, inaccurate plate welding, and wrong arc geometry), SBW struggled for 9 full days (10–19 August) and still failed to complete erection, forcing trusses with crane winches until the rafters buckled and bent permanently.
10 & 12 Aug Sohail Distress:
Sohail sent urgent videos and voice notes showing zero workers on site, crane standing idle incurring massive demurrage, and complete fabrication paralysis.
Rafters Bent & Damaged:
SBW attempted an uncertified lifting procedure without center-ring counter-weights. Main rafters deformed, twisted, and bent under improper crane strain.
Direct Labour Bailout:
SBW failed to pay his site workers. Workers struck work. On 18 August, Al-Barakah paid PKR 547,720.00 directly to workers to prevent physical violence.
Forensic Log: [8/18/26, 3:51 PM] Sohail Sb sends multiple videos of bent structural steel; Txn #38 (Rs. 447,720) & Txn #39 (Rs. 100,000) disbursed directly to site labour.
Hafiz Mohsin Forensic Site Inspection Gallery (20 August 2026)
On 20 August 2026, site assistant Hafiz Mohsin conducted a comprehensive photographic survey of the 165-ft dome shed. These photos capture the central compression ring misaligned, rafters bent and twisted under uncertified crane hoisting, unfinished outer perimeter purlins, and the total abandonment of the erection by SBW Engineering:
Proof of Material Breach:These photos provide conclusive physical evidence of SBW's technical incompetence and structural damage, directly justifying the retention of the Honda City collateral.
Transmitted continuous daily site photo/video logs. On 20 August, sent 16 forensic photos documenting zero workers, idle crane, bent structural rafters, and misaligned center ring.
Sohail (Al-Barakah Owner):10, 12 & 18 August 2026
Sent 15+ urgent distress audio messages and videos demonstrating complete panic as marquee event bookings approached while SBW defaulted. On 18 August, disbursed PKR 547,720 directly to SBW's unpaid striking workers.
Saleem Sb (Fusion Facilitator):28 July & Ongoing
Arranged Lahore bilateral mediation on 28 July (Sohail absent) and consistently urged amicable execution without taking any commission or financial custody.
Mian Usman (Coordinator / Tech Advisor):28 July – 29 August 2026
Delivered formal 6-page contract in 1 hour (11:43 PM), served 7 formal notices, and sent 65 voice notes enforcing fixed lump-sum scope, rejecting unearned cash demands, and recording Mazhar's agreements.

19 – 20 August 2026
SBW Quits, Alternative Vendor Request, Refund Cheque, Car Collateral & Final Signed Stamp Paper
Phase 5: The Final Binding Settlement
Facing total technical failure and structural damage, Syed Mazhar threw in the towel on 20 August 2026:
SBW Surrenders & Requests Alternative Vendor:
Syed Mazhar formally stopped work and requested Al-Barakah to engage an alternative fabricator/rigger to rectify the bent rafters and finish the dome.
Cheque Issued & Honda City Pledged as Collateral:
Mazhar issued a refund cheque. Because SBW is notoriously dishonest regarding cheque encashment, the Honda City vehicle was kept as physical collateral under mutual written consent.
Registered Legal Exhibit
Signed E-Stamp Paper (Dated 19/20 August 2026)
Syed Mazhar executed and signed this legal undertaking in the presence of witnesses, formalizing the voluntary deposit of the Honda City vehicle and cheque as security collateral against the unearned balance of PKR 2,710,128.00.
"All subsequent contract drafts or addendums generated in late August (such as the 32L Resumption Addendum) were never signed or agreed by Syed Mazhar. Therefore, under the Contract Act, 1872 and Pakistani jurisprudence, the 19/20 August Signed Stamp Paper is the FINAL, EXCLUSIVE, AND BINDING AGREEMENT between the parties. Syed Mazhar's subsequent police complaint alleging forceful snatching is a direct contradiction of this signed legal instrument and constitutes a criminal offense under Section 182 PPC."
The Honda City & Security Cheque Truth
Rebuttal to SBW's Malicious Claim of "Forceful Snatching / Extortion"
The False Narrative in Police Application
Syed Mazhar falsely claims that Al-Barakah took his vehicle (Honda City) and Cheque by coercion, threats, or force, alleging an offense under the Pakistan Penal Code.
Why this is an outright lie: No police complaint or 15 call was made on the day of handover. All handovers occurred amicably in the presence of witnesses as contractual security against unearned advances.
The Documented Factual Reality
After taking over PKR 2.71 Million in cash and bank transfers without completing the roof structure, Mazhar voluntarily pledged his vehicle and cheque to guarantee:
Mobilization of a certified rigging crew and cranes.
Completion of the 165-ft dome trusses and cladding.
Indemnity against the PKR 547k direct labour bailouts made by Al-Barakah.
Signed E-Stamp Paper: Contractual Collateral & Guarantee Undertaking
Executed & Signed by Syed Mazhar Abbas on 19 August 2026
Voluntary Handover Declaration: The Stamp Paper explicitly records that Syed Mazhar Abbas (SBW) voluntarily handed over the Honda City vehicle documents and post-dated security cheque as security collateral for structural completion.
Signed in Presence of Witnesses: Formally executed on 19 August 2026, witnessed, and delivered directly to Al-Barakah Marquee.
Protection Against Material Breach: Pledged against PKR 2,710,128.00 in disbursed advances and direct labour bailouts to prevent site abandonment.
Complete Criminal Rebuttal: This registered legal instrument conclusively disproves the fabricated police complaint of "holding or snatching by force".
Relevant Supreme Court & High Court Precedents:
"Where a negotiable instrument or property is delivered under commercial arrangements or as security for performance of a contract, disputes arising out of the retention or encashment thereof are strictly of a civil nature. Invoking the criminal process to secure the return of security collateral is an abuse of the process of law." — PLD 2021 SC 753 / 2022 PCrLJ 1140

باضابطہ قانونی بیان و مدلل موقف برائے قانونی چارہ جوئی (اردو)Re: Syed Mazhar Abbas (SBW) vs Al-Barakah
Official Evidentiary Statement & Legal Case Brief (English)Formal Written Submission
To: The Station House Officer (SHO), Concerned Police Station, Sheikhupura.
Subject: EVIDENTIARY REBUTTAL & RECORD REGARDING THE FRIVOLOUS APPLICATION LODGED BY SYED MAZHAR ABBAS (SBW ENGINEERING).
Respected Officer,
1. The criminal allegations leveled by Syed Mazhar Abbas (SBW Engineering) alleging forceful snatching or unlawful detention of a Honda City vehicle and cheque are wholly false, fabricated, and a malicious abuse of the police process. This is purely a civil and commercial construction dispute concerning the fabrication and erection of a 165-ft circular PEB dome shed at Al-Barakah Marquee.
2. Al-Barakah Marquee has disbursed over PKR 2,710,128.00 to Syed Mazhar across 17 direct bank transfers. While the structure was promised for 1st August, SBW started erection 10 days late on 10 August. For pre-fabricated PEB steel, erection is strictly a 1 to 2 day job; however, due to severe workshop fabrication flaws (misaligned bolt holes and distorted plates), SBW failed for 9 continuous days (10–19 August) to erect the structure, permanently bending rafters and twisting the central compression ring under forced crane pulling, before abandoning his unpaid workforce.
3. The 28 July 2026 Lahore Meeting (Sohail Absent): Mr. Sohail (Al-Barakah Owner) was NOT present at the Lahore meeting; only the third-party coordinators (Fusion Developers) sat with Syed Mazhar to note down preliminary negotiation points. To formally communicate and bind both parties, Fusion immediately formalized these points into the comprehensive Contract (FD-SBW-2026-001) and delivered it via WhatsApp within 1–2 hours. Under Clause 7 (Cheque Security), Syed Mazhar voluntarily pledged his vehicle documents and security cheque as performance collateral with Al-Barakah (Sohail) against unearned advances, entirely devoid of any force or coercion.
4. Zero Liability for Third-Party Coordinators (Fusion Developers): Saleem Sb and Mian Usman (Fusion Developers) act strictly as independent technical advisors and pro-bono facilitators. They hold zero financial interest, zero custody of the vehicle/cheques, and zero legal or financial liability.
5. Syed Mazhar's frivolous application is an extortionate tactic to evade civil accounting liability and constitutes a direct offense under Section 182 of the Pakistan Penal Code (PPC). It is respectfully requested that the application be dismissed and filed as a civil matter.
